These general terms and conditions of use ("General Terms and Conditions of Use") apply to use of the website www.adorelenses.com (“Website”) by users (“Users”).
Pursuant to and for the effects of art. 7 of Legislative Decree no. 70 dated 9.4.2003, Users are provided with the following information: the supplier of the services governed by these General Terms and Conditions of Use is Eyemed Technologies S.r.l., with registered office in Via al Boscaccio no. 3, 21011 Casorate Sempione (VA), tax code and VAT number 04253000964, e-mail: firstname.lastname@example.org (“Eyemed”).
The Website allows Users to purchase Eyemed products and/or to receive personalised suggestions and advice, including through direct contact with a qualified optician, on the correct use, maintenance and prolonged use of the products purchased, and also sends promotional messages and/or commercial information on Eyemed products (“Services”) via e-mail to anyone who has given their consent.
The User agrees to use the Services exclusively for legal purposes and, in any case, in accordance with laws on protection of personal data and intellectual property rights and shall not hold Eyemed liable for any claim or complaint deriving from use or abuse of the Services by said User.
Eyemed reserves the right to check compliance with these General Terms and Conditions of Use by the User, at any time and without prior notice, at its own discretion, and may stop supplying the Services to an individual User, definitively and without prior notice, if said User:
has not provided up-to-date, complete, truthful and correct personal data;
uses or has used the Services for illegal purposes and with illegal methods or any deemed by Eyemed to be incompatible with the nature of the Services supplied (such as, by way of example, transmission and/or exchange of viruses; sending or publication of personal advertising; chain and/or pyramid scheme e-mails; spamming or junk mailing; transmission and/or exchange and/or publication of illegal material or material with racist, defamatory, threatening, obscene or vulgar contents);
breaches or has breached the General Terms and Conditions or the special terms and conditions applicable to the Services.
Eyemed reserves the right to suspend or stop supply of the Services, including definitively, at any time and without prior notice.
Within the limits of current regulations, Eyemed accepts no liability for potential damages caused by suspension of the Services, even if this is a result of black-outs or faults of the servers of Eyemed or suppliers of Eyemed.
Eyemed reserves the right to suspend the Services for maintenance or updating of its own or its suppliers' computer systems, informing users via e-mail, notices on the Website, messages in the Services.
Eyemed accepts no liability for damages, claims or losses, direct or indirect, which the User suffers as a result of non-functioning and/or faulty functioning of the electronic devices belonging to the User or to others, telephone and/or data transmission connections not managed directly by Eyemed or by its suppliers.
The Website may include hypertext links to other websites managed by third parties, including adverts and other content suppliers. These websites may collect data or request the User's personal information.
Eyemed does not and is not required to perform any kind of control on said links and therefore accepts no liability for damages, claims or losses, direct or indirect, caused in any form to the User as a result of viewing, use and/or functioning of said third-party websites or services reached through said links.
The services are supplied for an indeterminate period, except in the case of withdrawal according to the requirements below.
The User, even if not a Consumer, is entitled to withdraw from the Agreement at any time through notice sent via e-mail to the following address: email@example.com.
Eyemed reserves the right to change these General Terms and Conditions at any time and also the terms and conditions and features of the Services, through general notices to Users published on the Website, indicating the date when said changes come into effect, which shall be at least 10 days after the date when said notice is given.
Users agree to print these General Terms and Conditions of Use and all subsequent change to them on paper or on an appropriate, long-lasting medium.
With the exception of contents which have been web-crawled, all the contents of the Website, such as, by way of non-limiting example, the text, the trademarks, the logos, the icons, the images, the illustrations, the audio and video recordings, the database, the source codes or software, the patents, are protected by copyright law no. 633/41, and are the property of Eyemed or third parties and/or Users, managed by Eyemed under express license/authorisation, including through said Users.
Therefore, without the written consent of Eyemed, except in the case of personal use, the User may not copy, amend, change, publish, promote publicly, distribute, sell or transfer any material and/or article and/or image and/or video and/or database and/or program strings present on the Website, either in full or in part.
By visiting the Website, the User agrees to comply with the following terms and conditions:
not to reproduce pages and frames present on the Website;
not to use the name of the Website and/or Eyemed;
not to reproduce articles, text, material or links of this Website;
for commercial purposes.
In particular, the User agrees not to:
use the Website in a manner such as to cause damage or damage others' rights;
use software and programs which could damage the Website;
change, alter, amend the “Look and Feel” of the Website or the programs.
By accepting these General Terms and Conditions of Use, the User agrees not to hold Eyemed liable for any claim, dispute, demand of third parties deriving from or connected in any way with the User's conduct in using the Website.
These General Terms and Conditions are governed by Italian law.
The court of competent jurisdiction for any dispute relating to these General Terms and Conditions, if the User is a Consumer, is the one in the place where the User is resident or domiciled, if located in Italy.
